1. Services Provided by Inspections Plus LLC
All services described on this website — including SWPPP development, stormwater inspections, BMP installation, erosion control, fugitive dust control, Phase I/II ESA, seeding, signage, and Trackout Control mat sales and rental — are provided by Inspections Plus LLC, a New Mexico limited liability company. By requesting services from Inspections Plus, or by using this website, you agree to these terms.
2. Estimates and Cost Ranges
Estimates provided by Inspections Plus are itemized unit-price estimates — not fixed-price contracts. Estimates are valid for 30 days from the date of issuance. Estimates are project-specific and do not constitute a binding agreement until a written Service Agreement is executed by both parties.
An estimate does not guarantee service availability or scheduling. Contact us to confirm availability before beginning any project planning that depends on our services.
Cost ranges shown on this website — including those displayed in the Free Site Analysis tool, on service pages, and in cost guides — are informed by industry sources including RSMeans construction cost data and Inspections Plus project history. Inspections Plus is not endorsed by or affiliated with RSMeans or its publisher. Cost ranges shown on this website are illustrative only and do not constitute price quotes or binding offers. Actual estimates depend on site-specific assessment, current material and labor rates, and the scope agreed in a written Service Agreement.
3. Written Agreements Required
All work performed by Inspections Plus is subject to a written Service Agreement or Work Order. No verbal agreements or email confirmations constitute a binding contract for service delivery. Work will not begin until a signed agreement is in place.
4. Regulatory Compliance Disclaimer
Inspections Plus provides professional stormwater compliance services consistent with applicable permit requirements. However, the Operator of Record named on any NOI or SWPPP — not Inspections Plus — bears the legal obligation of permit compliance under the Clean Water Act, NMR100000, AZPDES, MSGP, or any other applicable permit.
Inspections Plus is not the Operator of Record on any project unless explicitly stated in a signed agreement. We do not assume regulatory liability on behalf of property owners, developers, or general contractors.

8. Trackout Control Mat Rental Terms
Trackout Control mat rentals require a minimum 10 days advance notice for delivery scheduling. Availability is subject to current inventory. Rental period begins on delivery date. Return scheduling requires advance notice. Damage to mats beyond normal wear is charged at replacement cost.
9. Payment Terms
Payment terms are specified in the written Service Agreement for each project. Standard terms are net 30 days from invoice date. Late payments may be subject to interest per the New Mexico Prompt Payment Act (§57-28 NMSA 1978).
10. Limitation of Liability
To the maximum extent permitted by applicable law, Inspections Plus LLC's liability for any claim arising from services provided shall not exceed the total fees paid by the client for the specific service giving rise to the claim in the 12 months preceding the claim. Inspections Plus shall not be liable for indirect, incidental, consequential, special, or punitive damages, including lost profits or lost business opportunity, arising from use of this website, the Free Site Analysis tool, or any other tool on the website.
11. Indemnification
You agree to indemnify and hold harmless Inspections Plus LLC, its members, officers, and employees from any claim, loss, expense, or liability arising from: (a) your breach of these terms; (b) your use of this website or any tool on it; or (c) your reliance on any regulatory or cost information shown on this website without independent professional verification.
12. Binding Arbitration & Class-Action Waiver
Please read this section carefully — it affects your legal rights. Except for the carve-outs below, any dispute, claim, or controversy arising out of or relating to these terms, this website, or the services or tools provided through it shall be resolved by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its rules then in effect, rather than in court. The arbitration shall take place in Bernalillo County, New Mexico (or by video/telephone where the rules allow), and judgment on the award may be entered in any court of competent jurisdiction. The Federal Arbitration Act governs this section.
Class-action and jury-trial waiver. You and Inspections Plus LLC agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims. To the maximum extent permitted by law, you and Inspections Plus waive any right to a jury trial.
Carve-outs. Either party may (a) bring an individual claim in small-claims court if it qualifies, and (b) seek injunctive or equitable relief in court to protect intellectual-property or confidential-information rights.
30-day opt-out.You may opt out of this Arbitration & Class-Action Waiver section by emailing projects@inspectionsplus.com with your name and the statement “I opt out of arbitration” within thirty (30) days of first accepting these terms. Opting out does not affect any other part of these terms.
13. Governing Law
These terms are governed by the laws of the State of New Mexico, without regard to conflict of law principles. For any dispute not subject to arbitration under Section 12 (or if the arbitration provision is found unenforceable), the dispute shall be resolved in the courts of Bernalillo County, New Mexico.
